Statement from Gov. Vilsack About The Supreme Court's Nullification of the Iowa Values Fund
DES MOINES - " We respect and will fully comply with the Court's ruling. " I am proud that the Iowa Values Fund has been an effective engine of economic growth in Iowa. I am also pleased that our state will not face further reductions to schools and essential state services because of today's ruling. "I proposed creation of the Iowa Values Fund because I knew it would make Iowa an even better place to live, work and raise a family. I knew the job growth spurred by its passage would create a further sense of optimism and hope in Iowa. "As we mark the one-year anniversary of the passage of the Iowa Values Fund, the good work of this legislation continues. More than 11,000 jobs have been created or retained and more than $1.4 billion has been invested in our state. I remain convinced that Iowa is embarking on a journey of economic opportunity created from the passage of this legislation. We have just completed the greatest year of economic development in Iowa history. "I look forward to working in a bipartisan fashion to finalize the structure and operation of the Iowa Values Fund. With more than 142 job growth projects underway, the Iowa Department of Economic Development has agreements with over 30 of these projects that involved the Iowa Values Fund. We will honor our obligation to these companies. However, in recognition of the Court's ruling, we will not initiate further contractual obligations involving the Fund until a process is in place. "Now that the chapter of this litigation has been closed, its time to focus on our future. Challenges remain. We must find new funding of the Iowa Values Fund, we must improve our water quality, strengthen our commitment to the classroom and care for our seniors. Governor Tom Vilsack, June 16, 2004 Iowa Supreme Court nullifies Iowa Values Fund; says Vilsack overstepped authority Des Moines Register The Iowa Supreme Court, in a ruling released this morning, found that Gov. Tom Vilsack overstepped his authority when he item-vetoed a tax cut and other provisions of a bill that also created the state's premier economic development program. In an unexpected twist, the court ruled 7-0 that no part of House File 692 - not even the $503 million Iowa Values Fund - became law when Vilsack signed portions of it and vetoed other parts. (more)

Howard Dean: The Tax Cut Scam
by Gov. Howard Dean, M.D. For the past ten years many Americans thought they were getting tax cuts. In fact, they were losing money. While it is true that voters like the idea of tax cuts, they do not like the idea of cutting essential services, which is what is currently happening. For most working families, so-called tax cuts are simply an elaborate accounting shell game – lower income tax, but higher property tax . . . child tax credit, but higher college tuition . . . marriage penalty tax relief, but a 36 percent increase in health care premiums. For the average worker, with every dollar these tax cuts put in one pocket, it seems that two dollars are taken from the other. These tax cuts also happen to be the biggest factor in the creation of the largest and most chronic federal deficit in American history, roughly a half-trillion dollar added to our national debt every year. It gets worse. These policies are inflicting enormous deficits on our children, who will be forced to pay the biggest tax of all - a drop in their standard of living and education. This tax cut gimmick does not increase opportunity in America for the middle class and half-trillion dollar deficits hardly make our country more competitive. (Read the rest of the column here.)

Iowa Supreme Court To Rule on Landmark Case Today
Quad-City Times DES MOINES — The Iowa Supreme Court is expected to rule today in a landmark constitutional dispute between Gov. Tom Vilsack and Republican legislative leaders over the governor’s use of line-item veto powers. The court’s ruling, which is expected early this morning, could carry major policy implications. A Republican victory potentially could revive a $311 million package of income tax cuts and a long list of significant regulatory changes vetoed last year by the Democratic governor. But lawmakers argue that the biggest issue at stake is the constitutional balance of power between the Legislature and Executive Branch. Republicans charge that Vilsack upset that balance. Vilsack denies he moved to grab more authority. . . . . . . Taxpayers are paying bills for both sides in the struggle. Attorney General Tom Miller is defending the governor while lawmakers hired Des Moines attorney Richard Sapp to handle their case. “I believe this is a purely political exercise,’’ said Gordon Fischer, an attorney and chairman of the Iowa Democratic Party. He and other Democrats argue that taxpayers are being asked to bankroll what they consider to be a partisan legal maneuver. “I think it’s going to come back to haunt (Republicans),” he said. (more) |
